[CALIBK12] Query: Teacher's Picture on UTube.

I was approached by my principal today to ask how I would handle this
situation and wanted your advice. I told him that I could ask the
Listserv and he said YES! I will gather any info I get and hand it over
to my principal. Please respond off list. I am hoping that with many of
you taking 2.0 this summer, something of this subject may have been
discussed.

 

One of our students took a picture of one of our teachers. He then used
some type of software to animate the mouth to have the teacher hum along
with face movement to a song. He then posted this animation on his UTube
site.

When the principal found out about it, he turned it over to our district
Technology Department for action. They have reported it to UTube as a
violation, but have not received any response. The picture is not
obscene so it wasn't flagged right away. As UTube is blocked by the
school's filters, this picture can only be viewed via home computers.

 

What rights does the school have? Can the school demand that the picture
be removed?  Is asking that the picture be removed in violation of any
of the student's rights? Does only the person whose picture it is have
the right to demand that their picture be removed or can the school or
district act on their behalf?

 

Once this situation is taken care of, the principal wants to write an
"official" policy for dealing with situations like this in the future.
Although this is the first (that we know of), we also know it will not
be the last time we have to deal with this. It will be helpful to have
many different voices in coming up with this policy.
