[CALIBK12] Our American Century

Hi Everyone,

I am sure this has posted previously, but I am hoping for a new (a
better) answer.

We have the series "Our American Century" on video and 2 of the tapes
are broken.  The teachers love this video series-does anyone know of a
location that has these videos (in DVD or video format) for sale?  I
would buy the entire series again just to restore my collection.

Hi Darla and everyone:

I have to presume goodmoviesonline.com has permission to edit the films
and sell bowdlerized copies. The right to change a creative work is
reserved to the copyright holders, and it is often done for such things
as airplane movies.

If so, they are selling you the movie - it is listed as free, but it's
part of the sale deal. You have a legal copy if you purchase it from
them.

The other things that must be in place are:

*	Part of face-to-face instruction with a teacher and students
(i.e. the subject is part of the curriculum and is in the teacher's
lesson plan.)
*	Teaching occurs in a classroom or school library
*	The amount of the work used is not superfluous - only use as
much of it as needed for the lesson.
*	(It must be a legally obtained copy - purchased or borrowed is
OK)

It looks like you have fulfilled all 4 of these requirements, so you can
use any video/DVD under these circumstances even if it says "Home use
only"  

Many educational videos come in versions labeled for school use and they
have limited public performance rights, which relax some of the above
criteria. Check with the seller to see what rights you have, and get
them in writing. If there is any question, check with the copyright
owner (usually the company that produced the film.)

 

As for backup copies - Libraries, not schools, may make back up copies,
but can only use them in emergencies when the original is lost or
broken. They must attempt to purchase replacements. If a replacement is
not available, they cannot circulate the backup copy; the original and
the backup should be discarded. 

I try to think of it like a book - when a book wears out or some of the
pages fall out, we replace it. If it is out of print, we don't photocopy
the whole thing - that would be a copyright violation even if it is out
of print. In other words, it is pretty useless to make back up copies of
videos and DVDs (and CDs, cassettes, etc.) With a book, though, you can
copy and tip in up to about 10 pages if they are destroyed.

 

All of the above copyright provisions are guidelines and not law. I
believe we need to stand up for the few rights we have and use videos
within the guidelines before the rights are taken away. Copyright law
has only gotten more stringent over the years.

Hi Again to all calibk12 (and especially George Pilling who knows so
much about copyright laws),

Well, after I sent the notice below, a teacher talked to me about
potential copyright problems.  

I know that schools have always had the provision that a "backup copy"
of a piece of media could be created without breaking copyright laws.
So, when I read over the site info, I just thought in my mind that this
company is supplying the original and the backup.  But now I'm
questioning whether an edited version could be considered a "backup" or
is it a "new creation".  Ahhh, the laws and the lingo.  

Any thoughts?

My Library Technician just turned me on to this service.  Basically, if
you purchase the original version, they will throw in the edited (to PG
or PG13) movie for free.  Has anyone used this before and can vouch for
their service and quality?

By the by, The Patriot is in their catalog.

Hi Everyone,

One of my staff members is looking for a film that has realistic scenes
portraying the Revolutionary War. He would like it to be in the lines of
what we saw in the movie The Patriot obviously without the R rating.  If
you know of something like this, please let me know.
