We too make a district wide purchase through Movie Licensing USA each year. This covers the district should a movie be shown for other than educational purposes such as a reward or a rainy day showing. Before we purchased the licensing non-educational uses were not allowed but it was still happening.
20th Century Fox is the one major studio that is not covered by our licensing agreement. We can not charge for admission to have a family movie event but we can have a fundraiser involving other items at the same event.

Hi Alan,
I purchased this for the whole district while I was at Tustin Unified School District. I purchased it because it allows the showing of movies on rainy day; after school and rewards. If I remember correctly it also allows you to show a movie for student groups trying to get "donations" for their group. It can not be a fundraiser but it can be something that supports student activities. I would check with the vendor to make sure I am correct on this last point.
I am not saying I agree with these uses for showing movies but it covered the district for non-educational reasons for showing media.
There is one major studio that is not covered. I think it is Fox but you can ask which on is not covered when you talk to the vendor.
Otherwise you are correct if you are purchasing this to allow for in-class educational uses then this would be a waste of money. Teachers can show media for educational purposes if it builds on or adds to or is essential to educational content of the class. It helps if the title is written in a lesson plan.

Our district is looking at Movie Licensing USA (A Swank Corporation). If you have purchased a public performance site license, I would like to know which factors influenced your decision.
As for the Educational Exemption, if used correctly, wouldn't this offset the need to purchase a site license as long as the instructors and school are in compliance with the Face-to-Face criteria set up by Copyright Act of 1976, Public Law No. 94-553, 90 stat 2541: Title 17; Section 110(i)?
I am leery of private corporations who cite the "urgent" need to be "protected". But I would like to hear what other librarians or schools have done.
