California Education Code 

Section 35021

Utilization of Volunteers

 

(b) No district may abolish any of its classified positions and

utilize volunteer aides, as authorized herein, in lieu of classified

employees who are laid off as a result of the abolition of a

position.  A district shall not refuse to employ a person in a vacant

classified position and use volunteer aides in lieu of filling the

classified position.

 

   (c) It is the intent of the Legislature to permit school districts

to use volunteer aides to enhance its educational program but not to

permit displacement of classified employees nor to allow districts

to utilize volunteers in lieu of normal employee requirements.

Talk to your union rep. Every contract and every bargaining union is different, but it is my general understanding that a grievance can be filed against an employer for replacing a paid staff person with a volunteer.

Our School Board knew how many people in the community would want to come to the meeting to speak for the last time before they voted on the budget, yet they decided to hold the meeting in the same small room that the meetings are usually held. There were so many in attendance, the Fire Marshall came and gave the Board the choice to stop the meeting or clear out the room. The Board's decision was to postpone the meeting to a later time. 	 ey will vote on Thurs. Most of us think they will just base their votes on a list of recommendations from the district. I know that $17 million dollars is a ridicules amount of money to cut from a school district and we all have sympathy for the people who have to decide what to cut, but we are all very disappointed and disillusioned about this whole process, especially since we are all weary from going through this last year. I think the only thing that will save our libraries now will be money from the state or stimulus package.
	    One question I have is that we are trying to find out any legalities or violations that might come about from volunteers taking our places in the libraries. We are all Library Techs. Can they lay us off and replace us with volunteers? We need your help on this one. Thanks, Cheryl

	Be sure to check out the resources recommended on the www.csla.net <http://www.csla.net/>  under budget crisis. It has more there than March 15th notices. The Education Code says: 18100. The governing board of each school district shall provide school library services for the pupils and teachers of the district by establishing and maintaining school libraries or by contractual arrangements with another public agency. Contracting with another public agency isn't free and the resources in a public library, for example, are not selected with the school's curriculum in mind. It's cheaper and more effective to keep the libraries open and staffed! Keeping a good thought for tonight, Barbara

	Wow! Really good news. The PVUSD list of cuts includes closing all elementary libraries in the district and reducing staff in all middle and high schools. We do not have Teacher Librarians in our district. Please keep us in your thoughts. Meeting is tonight. Cheryl

	Good News1 The four Teacher-Librarians in Madera USD were on the cut list for the third year in a row, but we were removed from the final list of cuts which came out last night
	
	I really feel the HUGE advocacy efforts we all made (including Calib folk) from two years ago has paid off...the board members are essentially the same as then, That year our jobs were eliminated, but we got them back within a month!!
	
	Plus I have been at every recent board meeting doing a small presentation to the board, such as taking student-made posters for Black History Month, etc. Nothing dramatic, but being subtle and letting everyone know that we are still here.
	
	I am on the Madera Unified Teachers Assoc Exec board and am the rep for one of my middle schools to our MUTA Representative Council.
	So I have direct access to our union's decisions. I always pass this on to the teachers.
