California Education Code Section 35021.

(b) No district may abolish any of its classified positions and
utilize volunteer aides, as authorized herein, in lieu of classified
employees who are laid off as a result of the abolition of a
position.  A district shall not refuse to employ a person in a vacant
classified position and use volunteer aides in lieu of filling the
classified position.

So, then I wonder this......

Is there a section in Ed Code that states what may happen if ANY of the Ed. code sections are violated. You know, a general all-purpose penalty/consequence that may be considered or applied when an ed. code directive is blatantly disregarded and a particular code doesn't carry with it a specific penalty?


On the other hand, it certainly would lend itself as a basis for a lawsuit ala Williams. My thinking is that is what gives the ed.code, specifically 18100, its teeth-lawsuits and the courts. Not necessarily being "punished" by the CDE.

I'm intrigued.

Directed to anyone:

Has 18100 ever been put to the test?

Also, has "school library" ever been defined in Ed. code?

Sorry, no penalty is stated in that section of the Education Code.
