School districts across California might have to pull out a rarely-if-ever
used state law allowing them to lay off teachers after the normal May 15
deadline.

Education Code 44955.5 allows districts to hand out new pink slips between
five days after the enactment of the new budget and Aug. 15 if they don't
get at least a 2 percent increase in per-student state funding. State
officials said they can't recall anyone ever using the law.

Typically, teachers at risk of losing their jobs are given two notices of
layoffs - one by March 15 and a second on May 15.

In San Francisco, district officials were able to rescind the 400 or so
teacher layoff notices sent by March 15 this year after receiving about $29
million from the city. But given the continuing downward spiral of the state
budget, that may not be it.

"Obviously, we're still hoping not to have to lay off teachers for next
year, but we will have to monitor the options as the news keeps getting
worse," Deputy Superintendent *Myong Leigh* said.
